Delaware DUI law is governed by Del. Code Ann. tit. 21, sec. 4177 (the primary DUI statute), which prohibits operating a vehicle while under the influence of alcohol (at or above 0.08% BAC) or drugs (including cannabis, prescription medications, and controlled substances) or any combination thereof. Delaware's DUI law applies to operation of any vehicle on Delaware's public roads and highways -- from the I-95 corridor through Wilmington and Newark to the ocean highway (US Route 1) through Dewey Beach and Rehoboth Beach. Delaware's Traffic Law Enforcement Section (DLES) of the Delaware State Police conducts DUI enforcement statewide, while Wilmington Police Department, Newark Police Department, and various other municipal agencies enforce DUI within their jurisdictions.
Delaware's DUI processing and administrative hearings are notable for their integration with Delaware's Driver Services Division of the Delaware Division of Motor Vehicles (DMV; Wilmington Licensing Center and Dover Licensing Center). Delaware's implied consent law (Del. Code Ann. tit. 21, sec. 2742) requires drivers to submit to chemical testing, and refusal results in automatic administrative license revocation in addition to criminal DUI penalties. Delaware's beach resort communities in Sussex County generate a distinctive seasonal DUI enforcement pattern: the summer influx of hundreds of thousands of tourists from Washington DC; Philadelphia; Baltimore; and Wilmington into Dewey Beach (a mile-long beach town with a concentration of bars), Rehoboth Beach, and Fenwick Island creates DUI enforcement surges during Memorial Day; July 4th; and Labor Day weekends.
