Delaware County, Pennsylvania Immigration Law: what state law controls, what turns local, and where relief timing starts to matter

Immigration law reaches DELAWARE COUNTY — DELCO to the roughly 575,000 people who live in it — but it is almost never decided here. There is no immigration court in MEDIA, the county seat, and there never will be: every removal case brought against a resident of UPPER DARBY, CHESTER, DARBY, LANSDOWNE, or Springfield is heard at the PHILADELPHIA IMMIGRATION COURT, an office of the EXECUTIVE OFFICE FOR IMMIGRATION REVIEW (EOIR) inside the U.S. Department of Justice, a short ride up I-95 or the SEPTA Regional Rail. The DELAWARE COUNTY COURTHOUSE at 201 WEST FRONT STREET in Media — seat of the 32ND JUDICIAL DISTRICT and its Court of Common Pleas, with MAGISTERIAL DISTRICT COURTS spread across the county's dozens of municipalities — cannot grant asylum, cannot cancel a removal, and cannot stop a deportation. What a judge in Media can do is accept a guilty plea, admit someone to a diversion program, or enter a protection order, and any one of those can quietly decide a federal case the person never saw coming. There is one place where the county court reaches directly into status: SPECIAL IMMIGRANT JUVENILE STATUS (SIJS) requires a predicate order from a state juvenile or custody court finding abuse, abandonment, or neglect and that returning the child to the home country is not in the child's best interest — and in this county that order comes from a Common Pleas judge in Media. Everything else is decided in Philadelphia and at USCIS service centers around the country. But status is very often lost at 201 West Front Street.

The governing law is the IMMIGRATION AND NATIONALITY ACT (INA), a federal statute Pennsylvania cannot amend, soften, or opt out of. Three agencies split the work: USCIS handles affirmative benefits — green cards, naturalization, work authorization, affirmative asylum, and the humanitarian categories that matter most on the ground here, including U VISAS for crime victims, T VISAS for trafficking survivors, VAWA self-petitions for abused spouses of citizens and residents, and SIJS for abused, abandoned, or neglected minors; ICE prosecutes removal; CBP runs the ports of entry, including the marine terminals along the Delaware and operations at PHILADELPHIA INTERNATIONAL AIRPORT, part of which sits in TINICUM TOWNSHIP. Where Pennsylvania's own choices bite is at the edges, and Delco residents should know exactly where. PENNSYLVANIA DOES NOT ISSUE DRIVER'S LICENSES TO UNDOCUMENTED RESIDENTS — unlike neighboring New Jersey, New York, and Delaware — which turns an ordinary traffic stop on MACDADE BOULEVARD or BALTIMORE PIKE into an identity and fingerprint event and makes every drive to a job the transit map does not reach a summary offense. PHILADELPHIA is a sanctuary city that declines ICE detainers absent a judicial warrant; DELAWARE COUNTY IS NOT PHILADELPHIA, and county-level detainer and cooperation practice has moved with administrations — as of early 2026, verify current practice through a legal services organization rather than assuming either protection or exposure. The BERKS COUNTY family detention center closed in 2023, changing where regional detainees are held without reducing enforcement. Pennsylvania also mandates E-VERIFY for public-works contractors and, under ACT 75 of 2020, for construction-industry employers — a rule that lands on the trades rebuilding Delco's aging housing stock.

Delco's immigration story has a geographic center, and it is UPPER DARBY. The township is one of the most immigrant-dense places in the United States, and the corridor around the 69TH STREET TRANSPORTATION CENTER anchors it — home to one of the largest LIBERIAN and WEST AFRICAN communities in the country, alongside Indian, Bangladeshi, Vietnamese, and Latino blocks and a storefront economy of small businesses. The Liberian presence carries a legal history most Americans have never heard of. Liberians who fled civil war held TEMPORARY PROTECTED STATUS and then DEFERRED ENFORCED DEPARTURE (DED) for decades, extended administration by administration, and in 2019 Congress finally created a path off the treadmill: the LIBERIAN REFUGEE IMMIGRATION FAIRNESS (LRIF) provision let certain Liberians continuously present since November 20, 2014, apply to adjust to permanent residence. That filing window closed at the end of 2021, so for many Upper Darby families the live questions now are whether an application filed in time is still pending, what remains for those who missed it, and whether a current DED designation is even in effect — a status that changes with administrations and must be checked, not assumed, as of early 2026. The second pattern is criminal court, and specifically ARD. ACCELERATED REHABILITATIVE DISPOSITION is Pennsylvania's pretrial diversion program and the standard first-offense DUI path. Under Pennsylvania law, completion means dismissal and expungement eligibility; under federal law, INA 101(a)(48)(A) defines CONVICTION on its own terms, and a diversion program requiring an admission plus court-ordered conditions can satisfy that definition. What remains carries the load: MAIN LINE HEALTH's RIDDLE HOSPITAL in Media and LANKENAU on the county's edge, and TRINITY HEALTH's MERCY FITZGERALD HOSPITAL in Darby, a core safety-net site. None of them checks immigration status at the door and none may: EMTALA requires screening and stabilizing treatment regardless of status or ability to pay, and EMERGENCY MEDICAID covers emergency care for many Pennsylvanians ineligible for everything else. A family that avoids an emergency room after an I-476 BLUE ROUTE crash is trading a survivable injury for a rumor. Policing is fragmented across dozens of departments plus PENNSYLVANIA STATE POLICE coverage, and the agency that responds is the agency that decides whether a U visa certification request lands on a desk that has ever seen one — the DELAWARE COUNTY DISTRICT ATTORNEY is a certifying agency as well. Language access runs through the Pennsylvania courts' interpreter program under Title VI; Spanish capacity is well established, but the West African and South Asian languages of the 69th Street corridor are a thinner story, and a defendant who nods through a colloquy he did not truly follow has stacked a translation problem on top of a Padilla problem. Employers close the loop: the MARCUS HOOK and TRAINER refinery complex, BOEING's Ridley Park plant, and airport operations run I-9 verification, construction employers must run E-Verify under Act 75, and the storefront economy is where NOTARIO FRAUD does its quiet damage.

Start with representation, because IMMIGRATION COURT HAS NO PUBLIC DEFENDER — under INA 292 the right to counsel exists only at your own expense, and unrepresented respondents lose at rates that make the gap indefensible. LEGAL AID OF SOUTHEASTERN PENNSYLVANIA serves income-eligible Delaware County residents from its MEDIA office and handles the civil problems that tangle with status — housing, benefits, family — even where it cannot take the immigration case itself. HIAS PENNSYLVANIA, the NATIONALITIES SERVICE CENTER, and ESPERANZA IMMIGRATION LEGAL SERVICES are the region's anchor immigrant legal providers in Philadelphia, handling asylum, SIJS, U visas, VAWA, and naturalization, and the CLINIC network connects parish-based programs across southeastern Pennsylvania. The DELAWARE COUNTY BAR ASSOCIATION runs a lawyer referral service. Verify everyone: only licensed attorneys and DOJ-ACCREDITED REPRESENTATIVES at EOIR-recognized organizations may practice immigration law, and notario fraud has taken more money out of 69th Street kitchens than any enforcement operation ever has. The rules for households are concrete. Never accept a criminal disposition, ARD included, without an immigration lawyer reading the colloquy first. Keep every scrap that proves CONTINUOUS PHYSICAL PRESENCE — leases, ITIN tax returns, school and medical records, pay stubs, church records — because CANCELLATION OF REMOVAL for non-permanent residents requires ten years plus exceptional and extremely unusual hardship to a citizen or resident spouse, parent, or child, and ten years is something you prove on paper. Know that asylum carries a ONE-YEAR FILING DEADLINE from arrival, with narrow exceptions. Understand that a U visa needs a certification no agency is required to sign. Build the family plan before you need it: a Pennsylvania standby guardianship for the children, certified documents in one place a trusted person can reach, one phone number memorized. And never miss an EOIR hearing — an IN ABSENTIA removal order issues automatically and is brutally hard to reopen — which means filing a change of address with EOIR on Form EOIR-33 within five days of any move and with USCIS on Form AR-11 within ten. A notice mailed to the rowhouse you left in Lansdowne is not a defense.
