Family law cases in Bexar County are heard in the district courts, several of which sit as designated family courts, at the Bexar County Courthouse and the associated judicial facilities in downtown San Antonio, with filings handled by the Bexar County District Clerk (100 Dolorosa; 210-335-2113). Texas divorce law differs in important ways from many states. To file, at least one spouse must have lived in Texas for the preceding six months and in Bexar County for the preceding 90 days (Tex. Fam. Code §6.301). Texas has a mandatory 60-day waiting period after the petition is filed before a divorce can be finalized (Tex. Fam. Code §6.702) — far shorter than the six-month waits in some states. Texas allows both no-fault divorce (on the ground of "insupportability") and fault-based grounds such as cruelty, adultery, and abandonment (Tex. Fam. Code §§6.001-6.007), and fault can affect the property division and, in some cases, spousal support.
Texas is a community property state: property acquired during the marriage is generally community property subject to a "just and right" division by the court (Tex. Fam. Code §7.001), which need not be exactly equal, while separate property (owned before marriage, or received by gift or inheritance) remains with the owning spouse if properly traced. Bexar County's economy adds specific wrinkles — military pensions and benefits are common given Joint Base San Antonio, and their division is governed by federal law (the Uniformed Services Former Spouses' Protection Act) alongside Texas community property rules; and business interests, USAA and other employer retirement accounts, and real property require valuation. Spousal maintenance in Texas is comparatively limited: eligibility is restricted (generally requiring a marriage of at least 10 years plus an inability to meet minimum reasonable needs, or family violence, or a disability), and the amount and duration are capped by statute (Tex. Fam. Code Ch. 8).
Texas uses distinctive terminology for child custody. Instead of "custody," Texas courts appoint "conservators" — typically joint managing conservators, with one parent often having the exclusive right to designate the child's primary residence — and set out each parent's rights and duties and a schedule of "possession and access," frequently based on the Standard Possession Order (Tex. Fam. Code Ch. 153). The guiding standard is the best interest of the child. A case involving children is called a Suit Affecting the Parent-Child Relationship (SAPCR), which can be brought within a divorce or on its own for unmarried parents. Bexar County operates domestic relations services and requires parenting resources in many cases.
Child support in Texas follows statutory guidelines based on the paying parent's "net resources" (Tex. Fam. Code Ch. 154) — generally 20% of net resources for one child, 25% for two, 30% for three, and so on, up to a statutory cap on the resources to which the percentages apply, with adjustments for other children and for health-insurance and medical-support obligations. The Texas Office of the Attorney General Child Support Division establishes and enforces support orders (including for never-married parents establishing paternity) without requiring private counsel, and maintains a San Antonio office.
Domestic violence protection is available through protective orders under Title 4 of the Texas Family Code, filed in the district or county courts, and the Bexar County Family Justice Center and the Bexar County District Attorney's Family Justice Division assist survivors. Family Violence Prevention Services, which operates the Battered Women and Children's Shelter in San Antonio (24-hour crisis hotline 210-733-8810), provides shelter, advocacy, and legal support.
